Petition Details

India’s Hindu Nationalist govt abrogated article 370 from Kashmir illegally & human rights violation is on. In IoA, Lord Mountbatten stated “it is my Govt’s wish that as soon as law &order have been restored in Kashmir.., the question of the State’s accession be settled by a reference to the people”

Additional Information

India failed to keep its promise to conduct plebiscite. Indian then PM Nehru wrote to J&K’s PM: “It’s settled policy of Indian Govt that the Constitution of J&K is a matter for determination by the people of the state..”

As per IoA, if there is a breach of contract, the general rule is that parties are to be restored to the original position.
