Petition Details

Some British workers, despite being members of the Norwegian National Insurance Scheme are denied benefits on the grounds they are not registered as living in Norway. These workers cannot receive benefits anywhere and fail The Habitual Residency Test when they return to the UK seeking medical care

Additional Information

Despite the EEA Agreement and bilateral treaties between the UK and Norway on health, social security and tax, by denying (in contravention of EU Regulation 1408/71 Article 13(2)(c) applied to Norway by virtue of Annex VI of the EEA Agreement) residence permits to EU citizens, Norway used the pretext EU citizens, members of the Norwegian National Insurance Scheme could receive no benefits on the grounds they were not registered as living in Norway even if they were "tax liable" to Norway
