To over turn the doli incapax law.

Petition Details

A young child was sexually assaulted and raped from the ages of 6-10. And this was done by her cousin who is 3 or 4 years older than her. She has been trying since the age of 19 to get justice on this matter. Finally she was heard but trial got stopped as the defence used the doli incapax law.

Additional Information

Doli incapax law states a child of 10 to 13 don't understand right or wrong and evil acts. child knows what is right and wrong. The abuser in this case threatened the victim and scared her to not tell anyone so he was fully aware what he was doing was wrong.
If he thought it was a normal act would have openly done it than threatening her.
The trial lasted two days because of this law. Which is wrong where is the justice for victims. Rape is rape and doli inpacax should not be used.
