Criminal offence to provide false allegations in court to alienate a parent

Petition Details

A Mother can easily accuse a Father of wrongdoing and cease child access immediately. The Father must then go through a lengthy process to clear his name, all the time losing valuable time with his child. Anyone knowingly providing false accusations/statements should be criminally prosecuted.

Additional Information

Because CAFCAS have to take allegations seriously they have to advise no contact with the Father if strong allegations have been made against him. He then has to prove his innocence in multiple court hearings to gain even a glimpse of hope to see his child. Mother's who are found to have lied in court or to the police must be held accountable.

The Government e-Petitions Team gave the following reason:

We're not sure what you would like the Government or Parliament to do, because it's already against the law to lie in court.

Perjury is an offence under the Perjury Act 1911. The offence is committed where a witness under oath willfully makes a material statement in a judicial proceeding which they know to be false or do not believe to be true. The penalty for perjury can be a maximum of seven years imprisonment, or a fine, or both a fine and imprisonment.

It's therefore not clear what you would like to change.
