Make wrong public sector bodies determining engaging contractors IR35 status.
From April 2017, this is expected to change for public sector bodies and responsibility to operate the intermediaries’ rules falls on the engaging organisation.
This means that, for example, an NHS trust will have to review a locum doctor’s circumstances and decide whether or not to withhold PAYE and NIC, as if the locum were an employee. .This is wrong as public sector bodies will generalise it. As a result workers who are genuinely contractors will be made permanent.
