Petition Action

Prevent solicitors and barristers intimidating Claimants over costs in ET Cases

Petition Details

Prevent Solicitors and Barristers from intimidating Claimants by quoting inflated cost liabilities in Employment Tribunal cases. Instead make provision for a standard statutory notice to be sent to the Claimant which does not quote figures but cost rules for both sides.

Additional Information

Mrs "X" was intimidated with costs being quoted at £20k in a "without prejudice" eMail should she lose whereas the average Claimant payout is only about £6k. Mrs "X" was also intimidated on the day of the case verbally with the suggestion from the Respondent's Barrister to drop the case to avoid costs. The low payouts inevitably mean that the Claimant will be poorly represented. This kind of behaviour is not inline with the concept of accessible justice for employees in ET cases.

The Government e-Petitions Team gave the following reason:

Petitions need to call on the Government or Parliament to take a specific action. You could start a new petition explaining clearly what you would like the Government or Parliament to do.
