Flats:allow maintenance without Planning Permission
Current planning law requires flat owners to apply for planning permission for things most home owners regard as routine maintenance. The replacement of rotting, badly designed or poorly insulated windows one such action.
This is bad law because:
o Most people it applies to don’t know about it and go ahead in good faith, unknowingly breaking this law;
o Councils know there is a large amount of “unauthorised development” in this respect and act only when they receive a complaint;
o Enforcement is therefore capricious, so unfair;
o So far as windows are concerned, these restrictions act directly against the current push to have homes as well insulated as possible to reduce energy bills and environmental impact.
It needs to be changed.
