Petition Action

Stop a parent Claiming CMS When other parent already pays directly.

Petition Details

I split from my ex 2 years ago now, For 2 years i have paid money to my ex for OUR children. Today i received a letter from child maintenance service stating that she has started an application. The Agreement between me and my ex was £160 a month, and that is how it has been for 2 years.

Additional Information

Well through CMS that goes up to nearly £400 a month. I live on my own, yes i work full time and struggle to live as it is without things being made easy for the other parent.

I call on Parliment to make it impossible for a parent to make a claim through CMS when the other parent has been paying. I Also call on the goverment to make CMS change the way the calculate the payments.
being calculated before tax is wrong, and the fact they dont take into account your bills or debts.

This petition was rejected

The Government e-Petitions Team gave the following reason:

Petitions need to call on the Government or Parliament to take a specific action. We're not sure whether you'd like a new law that says that the Child Maintenance Service can only accept applications from parents who have never had a voluntary maintenance agreement; whether you'd like the CMS to change how it calculates maintenance payments; or something else.

You can find out how to challenge a maintenance decision here:

You could start a new petition explaining clearly what you would like the Government or Parliament to do.
