PARLIAMENT MUST DEBATE THE LEGALITY (UNDER VCLT:1969) OF UK ENTRY INTO THE EU
Article 53, VCLT: 1969 states: 'A treaty is void if, at the time of its conclusion, it conflicts with a peremptory norm of general international law which include secret negotiations, misleading the people of the signature State and failure to conform with the constitution of the signature State.
Equally no Treaty is valid if people of that State were misled as to the intentions of a treaty.
Article 26, VCLT states that every treaty must be performed in 'good faith'.
It has become apparent with the republication of document FCO 30/1048:71 that Prime Minister Heath, and all subsequent Governments were complicit to a certain extent, when assuring the People and Parliament that there was no question of surrendering national sovereignty.
