Petition Action

Government to amend rules so GPs can charge Solicitors for postage for SAR.

Petition Details

GDPR has put a financial burden of £25 for postage on GP Practices for Subject Access Requests (SAR) for litigation cases from Solicitors. Solicitors are capitalising on this as opposed to requesting Access To Medical Records which carries a fee. GP time to remove sensitive data is not recoverable.

Additional Information

Historically practices could charge up to £50.00 to cover the consumables and postage charges.
Solicitors are requesting information under a SAR request despite it clearly being for litigation. Patients are consenting to full medical records which under data protection is excessive in line with the Caldecott principals.
