Section 59 allows the police to give drivers a warning if they are reported to have used their vehicle in a manner which causes "alarm, distress or annoyance". If reported to have done so again within a year the police have the right to confiscate the vehicle. There is no right of appeal and decision are often based soley on witness statements. This goes against the basic right to have a fair trial and be judged by an impartial tribunal. For this reason S59 should be repealed or amended to allow decisions to be appealed in court.

The Government e-Petitions Team gave the following reason:

The petition should refer to s59 of the Police Reform Act 2002 (rather than the Road Traffic Act 1988). The petitioner may wish to resubmit an amended the petition, making the Home Office the relevant department (since police powers are a Home Office matter), However, before doing so the petitioner may wish to check the provisions of the Act (see http://www.legislation.gov.uk/ukpga/2002/30/section/59), as there is no mention of a second offence within a year.
