Petition Details

Create an emergency law that allows workers (and those who fall under IR35) to challenge their dismissal after the passing of a crisis if, on review by the courts, it was found to be uneccesary for the survival of the business or motivated by any reason than one genuinely necessary to the crisis.

Additional Information

Workers/contractors need to be protected from irresponsible/callous actions by employers during a national crisis. Business is assured financial assistance however there is no mechanism to ensure that these social gestures of financial aid, paid for by taxpayers money, also protect the interests of the individual taxpayers in the employ of the businesses that benefit from them. Businesses must also not be allowed to take advantage of the vulnerability of individual workers for their own gain.

The Government e-Petitions Team gave the following reason:

We understand that you want the Government to protect workers who might lose their job during the coronavirus outbreak, but it's not clear what exactly what you you want the Government to do to achieve this.

There are already rules about how employers can fairly dismiss their staff, including by making them redundant: www.gov.uk/dismiss-staff/fair-dismissals

These rules continue to apply during the coronavirus outbreak, and employees can appeal their dismissal directly with their employer, or through an Employment Tribunal. The Government has published advice on what to do if you're dismissed: www.gov.uk/dismissal/what-to-do-if-youre-dismissed
