Creation of a tort of breach of privacy
We the undersigned wish the HM Government to take further action to protect the privacy of individuals from intrusion, by the creation of a course of civil action of Breach of Personal Privacy.
At the current time, judges have to "shoehorn" cases concerning privacy into the old tort of "breach of confidence." This has created confusing law regarding personal privacy which leaves many unprotected.
As such, we demand that statutory provision be made for the creation of a free- standing tort of Breach of Personal Privacy, which would allow courts to grant injunctions and award damages to those whose privacy is at risk of being breach or already has, and make the law much clearer to those whose privacy is at risk as well as those at risk of performing an intrusion.
