The Right to give a truthful employee reference without fear of litigation

If requested by a new employer, the previous employer should be permitted to give a truthful and accurate reference that details the good, the average and the bad points about an ex-employee without fear of litigation by that ex-employee.

For the future employer, a rogue employee is discovered by trial and error. It is very poor show if the only response you receive to a reference request these days is their dates of employment and last rate of pay.

The employee should be entitled to see that reference and have a right of appeal via ACAS.

In doing so:
Business will suffer fewer losses and improve productivity
Employees will be aware that rogue behaviour will follow them from job to job
