In Intestacy - Grant the Surviving childless spouse her rights - Law of Succession.
Should the Surviving childless spouse be granted the right to inherit the whole estate.
They should be seen as a key member of the family, not an interloper as this Law implies.
Since 1990 -various proposals, with the same recommendations (word for word).
.1. Where a person dies intestate survived by a spouse but not by issue the spouse or cp should inherit the whole of the net intestate estate. (Draft Bill,sect 2 (2))
The Scottish People Polled-voted in favor of it,(94% /89%.Since devolution 13years ago, NIL
The Govt continually ignore this issue.
It's not in keeping with the way we live our lives in the 21st Century, L.O.S-1964 is outdated & an unjust Law, “no person should precede a living lifetime spouse”
I ask our Scottish Government to address this issue with a matter of urgency, granting a surviving childless spouse their rightful place,to inherit the whole estate.
