Auto-enrolment should not apply to those with lifetime allowance protection
Auto-enrolment legislation is being brought in to get people saving for pension by moving to an opt-out system rather than an opt-in system.
There are over 20,000 people with Enhanced Protection (source Freedom of Information request from November 2010) and an unknown but expected high number of people with Fixed Protection. These represent people who have saved sufficient pension that they are concerned about the £1.5m Lifetime Allowance.
They should be excluded from Auto-Enrolment automatically as there is only a downside to them - that they forget to opt-out and end up losing their lifetime allowance protection which would cause an additional unwarranted tax charge.
