The Government are seeking to allow private sector employers to override the protected persons regulations in order that they, the employer, following the introduction of the single-tier state pension, can offset any additional costs they may face as a result of the end of defined benefit contracting out and the loss of the NI rebate.
The Government has already considered it right, and has prepared draft legislation, to enable private sector employers to change their scheme rules to offset their additional NI costs and to do so without trustee consent.
This Government should immediately cancel the draft legislation and withdraw from any future attempt at changing Private Sector Scheme Rules without the consent of all members of such a scheme.
