Passengers Hit By Long Delays EU Reg EC261/2004
The Court of Justice (CJEU) judgment in the case of TUI Travel & others v CAA confirms that passengers whose flights arrive more than three hours late may be entitled to compensation for the delay in line with EC Reg 261/2004, unless extraordinary circumstances, outside their airline’s control, delayed the flight. And on the 23 Oct 2012, it was further clarified.
Forums are showing that claims made in Oct/Nov 2012 have still not received any constructive replies, much less compensation.
HM Government should enforce the EU ruling in order to ensure that where airlines that are at fault in these delays (and not down to acts of god), they cannot just sit on their corporate hands and drag out any compensation payment for as long as they can get away with it.
