Petition Action

End DNACPR orders for when “Learning Disability” is stated as the reason.

Petition Details

Many people in our society have intellectual disabilities, there are 1 million people living with learning disabilities across England and Wales alone. A learning disability is NOT a valid reason for someone to not be resuscitated & yet many people are being given DNACPR orders for just that reason

Additional Information

If this was made illegal, it would save many people’s lives and give people a choice they otherwise would not have. It would protect the rights of the person and their family and friends in the decision of a DNACPR order. The fact a DNACPR order can be given to you only for having a diagnosis of a learning disability is clear discrimination and against everything taught in the NHS and discrimination and discriminative practice should not be accepted in the National Health Service.

The Government e-Petitions Team gave the following reason:

Decisions about do not attempt cardiopulmonary resuscitation (DNACPR) orders are made by individuals and clinicians, not the Government or House of Commons.

The NHS has written to all trusts and accountable officers stating that ‘do not attempt cardiopulmonary resuscitation’ (DNACPR) orders should only ever be made on an individual basis and in consultation with the individual or their family, and that the key principle is that each person is an individual whose needs and preferences must be taken account of individually: www.england.nhs.uk/coronavirus/wp-content/uploads/sites/52/2020/04/maintaining-standards-quality-of-care-pressurised-circumstances-7-april-2020.pdf

You can read an interim report of the Care Quality Commission into the application of do not attempt cardiopulmonary resuscitation (DNACPR) decisions during the COVID-19 pandemic here: www.cqc.org.uk/news/releases/cqc-finds-combination-increasing-pressures-rapidly-developing-guidance-may-have
