Petition Action

Reform legislation on evidence admissible in sexual assault and rape cases.

Petition Details

I believe that this is necessary in order to allow prosecutors to present a wider range of evidence for example, relating to the character of the defendant and whether there are similar charges against the defendant.

Additional Information

As it stands, with today's legislation around sexual assault, victims suffer more than perpetrators when it comes to reporting sexual assaults. Perpetrators walk away without punishment due to restrictions on evidence. This is demonstrated by the fact that so few reported rapes and sexual assaults result in a conviction. Perpetrators are then free to potentially offend again. Through changing the law, it is more likely that victims will receive justice, preventing the risk of future offences.

This petition was rejected

The Government e-Petitions Team gave the following reason:

Petitions need to call on the Government or Parliament to take a specific action.

We're not sure exactly what you'd like the Government or Parliament to do. It's already possible for bad character to be raised in prosecutions, subject to legal protections. See for example:

www.legislation.gov.uk/ukpga/2003/44/section/101

If you'd like to change the rules on when it could be used, you could start a new petition explaining clearly what you would like the Government or Parliament to do.
