Right to fair hearing in employment disputes for civil servants
There is a presumption in law that civil servants are entitled to the guarantees of article 6 of the European Convention on Human Rights in employment disputes. Following the decision of the European Court of Human Rights in the case of Eskelinen v Finland [2007] ECHR 63235. The government should amend the Discipline section of the Human Resource policies to provide legal representation at disciplinary hearings where the penalty includes dismissal, along with disclosure of documents, bringing of witnesses against and for as well as providing an impartial decision maker.
