Petition Details

Change the Right to Light Law so homeowners who've lived in their property for 20 years or more are automatically entitled to the same light without having to go through a survey to calculate actionable injury

Additional Information

I think it is unfair that someone who has lived in their property for over 20 years or more have no proper rights when neighbours build overshadowing extensions blocking the light coming into their home. After living in their property for so long, I think they should be automatically entitled to the same light, especially when their home has been bought and paid for. I am thinking of the elderly who are not in a position to fight a Rights to Light case and get taken advantage of.

The Government e-Petitions Team gave the following reason:

We understand you're concerned about protecting homeowners' Right to Light, however in the absence of a survey, it is not clear how developers would know which homeowners' permission was needed, if any, i.e. how to determine whether a loss of light was actionable or not.

You could start a petition calling for the law to be changed to introduce a particular objective test (rather than a more subjective survey) to determine whether a loss of light is actionable in these cases, if that is something you'd like to see happen.
