The right for a prompt external independent review of individual NHS complaints.
At the moment a patient of the NHS who is experiencing medical bad practice has no real way of challenging the system. An independent body should investigate NHS complaints promptly before the need for litigation.
At present there is no real way of challenging the NHS
complaints system except for litigation after the event. In 2020 NHS England faced £4.3bn in legal fees to settle outstanding claims. Each year the NHS receives 10,000 new claims for compensation (source BBC reports 21.1.20). NHS litigation costs could be reduced significantly as a result of early intervention of complaints being resolved before litigation using the proposed scheme.
