Give divorcing parties an absolute right to a ‘clean break’

Petition Details

Following a divorce, the former spouses must overcome an emotionally trying period and make a new life. The new life should include the freedom to decide what to own and how to invest his or her assets. A ‘clean break’ should be an absolute right.

Additional Information

The law should be changed so that, unless both parties agree otherwise, all jointly owned assets (including the former marital home) are sold. Liability for outstanding joint debts should fall equally and individually – neither should be liable for the other’s debt. Parties should have first refusal to buy the other party’s share of assets or may enter into a voluntary agreement for joint ownership, but judges should not have the power to order parties to continue joint ownership.
