Legally recognise non binary gender identity.

Petition Details

Have non binary be included as an option under the GRP (Gender Recognition Panel)/ GRC (Gender Recognition Certificate), in order to allow those identifying as non binary to be legally recognised as their true gender identity.

Additional Information

Parliament debated this topic on 23 May 2022 and announced that despite public support, there are no plans to amend the Gender Recognition Act 2004. This Government claims that it wants everybody in the UK to feel safe and confident to be themselves. Without legal recognition, non binary individuals are actively discriminated against by our Government. The right to marriage or civil partnership, for example, is unavailable to non binary persons.

Government Response

The Government responded to this petition on Friday 19th May 2023

The Government believes the provisions of the Gender Recognition Act 2004 are effective and has no current plans to review or change the Act.

The Government is committed to ensuring the UK is a society that works for all people, regardless of their background or identity, and where they are able to pursue their goals and ambitions without facing unlawful discrimination.

In 2018 the then Government launched a public consultation to consider reform of the Gender Recognition Act 2004. This consultation did not cover non-binary identities; the introduction of provisions to recognise non-binary identities via the GRA was not under consideration.

As announced in September 2020, we believe the current provisions in the GRA are effective and allow for those who wish to legally change their sex to do so. The Government has no plans to recognise non-binary identities in UK law, whether via the Gender Recognition Act 2004 or more widely.

We will continue to consider emerging data and research on the experiences of non-binary people to better understand how future policy can be developed.
