Petition Details

Currently anyone who have been proven to make false allegation of rape/ sexual assault can only be charged with wasting police time with a maximum sentence of 6 months when the victim could have faced life in prison, make this it's own offence with a minimum mandatory sentence of 90 days in prison.

Additional Information

Create a separate act to make false allegations of rape/ sexual assault its own criminal offence with a mandatory minimum sentence of 90 days so it can be punished accordingly.

Depending on the circumstances people who have made false accusations of sexual offences, including rape, could be prosecuted for either wasting police time or perverting the course of justice. Perverting the course of justice has a maximum sentence of life imprisonment.

Decisions prosecuting alleged crimes, including what offence someone is prosecuted for, are a matter for the Crown Prosecution Service, not the Government or Parliament.
