EXCLUDE BROADBAND INFRASTRUCTURE FROM PERMITTED DEVELOPMENT LEGISLATION
Government must remove permitted development rights for broadband infrastructure, so telecomms operators must apply for permission to the Local Planning Authority (LPA) on proposed installations & the LPA must consult with & have agreement from affected residents before issuing permissions.
Broadband infrastructure installed by operators for the expansion of FTTP broadband does not need planning permission under the Electronic Communications Code (Conditions & Restrictions) 2003 & The Town & Country Planning (General Permitted Development (England) Order 2015.
There is currently no requirement to share infrastructure or to inform residents of the installation.
Additionally, Codes of Practice should be MANDATORY because code operators are ignoring voluntary Codes of Practice.
