Mandetory custordial sentence for causing careless or inconsiderate driving
current guidelines on sentencing for causing DEATH BY CARELESS OR INCOSIDERATE DRIVING are far too lenient
Statutory Limitations & Maximum Penalty:
On indictment - 5 years imprisonment,
On summary trial - 6 months imprisonment.
Minimum mandatory disqualification -12 months.
Mandatory endorsement 3 -11 points.
Discretionary re-test (s.36(4) RTOA 1988
Although it could be argued that the person responsible 'has to live with it' for the rest of their lives, the current sentencing makes a mockery of the suffering endured by the bereaved for the rest of their lives.
All too often we hear of drivers given a 12 month ban, x amount of hours of community service but are free to leave the court room. That is no justice to the friends and family that have to live a life sentence without a loved one.
I ask the government to make death by careless or inconsiderate drive a mandatory custodial sentence
