To the House of Commons

The petition of citizens of the United Kingdom, Declares that:

Although campaigns educating people on how to dispose of rubbish have had some limited effect, legal options open to councils to tackle fly-tipping and litter are not fit for purpose, restricting progress. The presence of waste or litter on land or property should, within reason, be the only evidence required to take enforcement action.

The Derby Telegraph, Derby City Council and Normanton Empowerment Team request that the House of Commons change the law so:
• property owners must keep their land free from litter and waste.
• the burden of proof to prosecute for fly-tipping is reduced from “beyond reasonable doubt” to “on the balance of probability”.
• powers are introduced to make it an offence for a person questioned by a council enforcement officer on a litter or fly-tipping matter to withhold their personal details.
