Advocate in Parliament for fair and robust transitional protections, ensuring that individuals who entered under the five-year ILR framework are permitted to continue on that path.Seek clarification from the Home Secretary ten-year ILR rule will not be applied to current Skilled Worker visa holders.
The possibility of a retrospective application of the proposed ten-year ILR rule is deeply concerning. Such ambiguity has already generated significant anxiety, financial uncertainty, and emotional distress.
This situation raises critical questions regarding the principle of legitimate expectation. These terms retrospectively would convey a damaging message to current and prospective skilled migrants—that the UK may not uphold its commitments.
