Review consent law to protect neurodivergent people from miscarriages of justice
We ask the Government to review consent law to ensure courts and juries consider neurodivergence and relationship context when judging belief in consent. Neurodivergent people need fair legal protections to prevent miscarriages of justice in sexual offence cases.
We believe current consent law does not reflect how neurodivergence affects communication, perception, and responses to questioning. Courts may overlook these differences, leading to unfair trials and wrongful convictions—especially in ongoing relationships. The law must ensure that neurodivergent people are properly understood and supported when consent or intention is in question.
