We ask the UK Government to stop introducing an “earned settlement” requirement for families linked to British citizens, including spouses and parents. This includes proposals that would require them to meet additional earnings requirements for a further 3 to 5 years before they can apply for ILR

Additional Information

These proposals are unfair and risk breaching Article 8 family life rights. For family visas such as spouse and parent visas, the British sponsor already must meet the £29,000 income requirement (previously £18,600). In many families, the dependent partner cares for children or the home and cannot meet extra earning rules. Requiring 3–5 more years of earnings before ILR would unfairly affect thousands of families and delay stability for households raising British children
