Review and amend the “balance of probability” standard in police misconduct cases. We believe the current low threshold risks dismissal following flawed or incomplete investigations, with inadequate disclosure. Stronger safeguards are needed to ensure fair, thorough, and evidence-led outcomes.

Additional Information

Decisions in police misconduct cases can end careers and damage lives. We are concerned that the “balance of probability” standard allows dismissal even where investigations are incomplete or evidence is not fully disclosed. This can risk unfair outcomes and undermine trust in the system. We think stronger safeguards are needed to ensure investigations are thorough, transparent, and evidence-led before such serious decisions are made
