Do not remove existing legal rights for children and young people with SEND
Legal entitlements are vital safeguards for children with SEND. The Government must protect rights to needs-based assessment and support, with independent accountability through the SEND Tribunal. Reform can strengthen support without reducing or removing legal rights.
SEND reform proposals shift from supporting individual needs and securing specified provision to pre-defined Specialist Provision Packages. The threshold for EHC needs assessments would rise, leaving children without the support they need. Individual Support Plans lack legal enforceability, leaving families with limited recourse if they disagree or support isn’t delivered. Proposals weaken SEND Tribunal powers, reducing independent routes to challenge decisions and secure appropriate provision.
