Review compliance process for financial orders in divorce settlements.

Petition Details

We believe similar enforcement to CMS mechanisms should exist for financial orders made in divorce proceedings, so that once a court order is made, compliance is monitored and enforcement action can begin automatically if the order is not followed.

Additional Information

Currently, if a person refuses to comply with a court-ordered financial settlement, the other party must return to court and apply for enforcement, causing further financial hardship, delay, and stress. This system can allow ongoing financial or economic abuse after separation.

We believe that once a judge has made a legally binding financial order, the court system should be made to monitor compliance and begin enforcement automatically if the order is not followed.
